Unless its on the tag, I think you can rate your own capacity here.
I know when I've boughten boats in Texas and brought them here I had to fill in my own capacities. Guess I need to do more checking with the DNR. :confused1

This is how the regulation for Iowa reads :

The passenger capacity number, as assigned by the DNR, shall be painted on or attached to the starboard side of the vessel within nine inches of the transom. It shall conform in size and color to the numbers and letters on the bow. The number of persons shown on the manufacturer's capacity plate is to be placed on the registration certificate and on the right side of the boat as outlined above. If there is no plate, then the capacity of the boat is "operator's responsibility" and the letters "OR" must be placed on the certificate and on the boat in place of the number.

My 21'4" Baja Hammer says 6 is the capcity. A friend's 20' Crownline bow rider says 10. Go figure. Here in Iowa we are supposed to post our capacity on the right rear side of the boat. Many say OR which means owner responsibility. If you do not have a coast guard tag that specifies, then I guess you can get away with the OR rating. The Coast Guard must consider the number of seats, as I think my Hammer is more sea worthy than the Crownline bow rider.
